These Terms and Conditions govern your access to and use of the Map and Track platform, website, software, tools, and associated services.
Map and Track is operated by LESSER Innovations, trading as Map and Track.
By accessing, registering for, or using Map and Track, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these Terms, you must not access or use Map and Track.
1. Definitions
In these Terms:
“Map and Track”, “we”, “us”, or “our” means LESSER Innovations, trading as Map and Track.
“Platform” means the Map and Track website, web application, software, tools, reports, visualisations, and associated services.
“User”, “you”, or “your” means the person, organisation, agency, or entity accessing or using the Platform.
“Location Data” means any GPS data, mobile device location data, KML data, cell tower data, Wi-Fi location data, coordinates, timestamps, route data, movement data, annotations, reports, or other location-related information imported into, created in, or analysed using the Platform.
“Project Data” means any project file, analysis session, uploaded file, generated report, saved workspace, user-created annotation, or related investigative material created, imported, viewed, or processed using the Platform.
2. Acceptance of Terms
By accessing or using Map and Track, you agree to comply with these Terms and any additional terms, notices, or policies made available through the Platform.
If you are using Map and Track on behalf of an organisation, agency, employer, or other entity, you confirm that you are authorised to accept these Terms on behalf of that entity.
If you do not agree with these Terms, you must immediately stop using the Platform.
3. Description of the Platform
Map and Track is a digital location analysis and visualisation platform designed to assist investigators, analysts, forensic practitioners, and other authorised users in reviewing and interpreting mobile device location data.
The Platform may allow users to import, view, filter, map, analyse, annotate, replay, and report on Location Data.
Map and Track is intended to assist with analysis and presentation. It does not replace forensic examination, expert review, legal advice, investigative judgement, or independent verification of source material.
We may modify, update, suspend, restrict, or discontinue any part of the Platform at any time, including features, reports, tools, workflows, or supported file formats.
4. Investigative Assistance Only
Map and Track is provided solely as an investigative and analytical aid.
The Platform does not independently determine, and must not be interpreted as determining:
- legal conclusions;
- criminal liability;
- civil liability;
- intent;
- culpability;
- identity;
- causation;
- presence at a location;
- involvement in an incident;
- accuracy of the original source data; or
- the reliability or admissibility of any evidence.
No output from Map and Track constitutes legal advice, expert evidence, a forensic conclusion, or a definitive finding of fact.
Any maps, timelines, reports, annotations, movement paths, density views, intelligence zones, or other outputs generated by the Platform are tools to assist review and interpretation only.
5. Limitations of Location Data
You acknowledge that Location Data can be inaccurate, incomplete, delayed, duplicated, mislabelled, misinterpreted, or affected by technical limitations.
Location Data may be influenced by, among other things:
- device settings;
- operating system behaviour;
- application behaviour;
- GPS signal quality;
- Wi-Fi positioning;
- cell tower coverage;
- network conditions;
- carrier records;
- sensor accuracy;
- time zone settings;
- clock drift;
- data export processes;
- forensic tool parsing;
- interpolation;
- caching;
- environmental factors;
- indoor or underground use;
- poor signal areas;
- data corruption; or
- human error during collection, export, import, or interpretation.
Displayed positions may not represent the exact real-world location of a device or person at any particular time.
A route, line, point, cluster, heatmap, animation, or report generated by the Platform should not be assumed to represent an exact journey, precise movement path, or confirmed physical presence unless independently verified against reliable source material.
6. Independent Verification Required
All outputs from Map and Track must be independently verified before they are relied upon.
You are solely responsible for verifying any Platform output against appropriate source material, including but not limited to:
- original forensic extractions;
- forensic tool reports;
- source databases;
- KML files;
- device records;
- carrier records;
- cell tower records;
- timestamps;
- time zones;
- chain-of-custody records;
- exhibit records;
- witness evidence;
- CCTV;
- business records;
- other investigative material; and
- any relevant expert advice.
You must not rely solely on Map and Track to make operational, investigative, legal, disciplinary, evidentiary, or court-related decisions.
Any finding, conclusion, report, briefing, statement, or presentation prepared using Map and Track remains your responsibility and must be independently checked for accuracy, context, and proper interpretation.
7. User Responsibility
You are solely responsible for:
- ensuring you have lawful authority to access, upload, import, process, and analyse any data used with the Platform;
- ensuring your use of the Platform complies with all applicable laws, warrants, policies, procedures, and organisational requirements;
- checking the accuracy, completeness, provenance, and reliability of any data imported into the Platform;
- correctly interpreting timestamps, time zones, coordinate formats, map layers, routes, and location accuracy;
- determining whether any data is suitable for the intended purpose;
- reviewing and validating all outputs before relying on them;
- maintaining your own records, notes, files, exports, and backups;
- protecting sensitive, personal, confidential, forensic, or evidentiary material;
- ensuring that any reports or outputs are used appropriately and lawfully; and
- obtaining legal, forensic, technical, or expert advice where required.
You acknowledge that incorrect use of Location Data may lead to misleading or inaccurate conclusions.
8. Local Processing and No Storage of Location Projects
Map and Track is designed so that Location Data and Project Data are processed and analysed locally within your web browser.
We do not store your Location Data, project files, imported datasets, waypoints, routes, movement history, annotations, generated project content, or analysis projects on Map and Track servers.
You are responsible for saving, exporting, preserving, and backing up any project files, reports, screenshots, or analysis outputs that you wish to retain.
If you close your browser, clear your browser data, lose access to your device, fail to save a project file, overwrite a file, delete a file, experience browser failure, or otherwise lose data, Map and Track may not be able to recover that data.
Map and Track is not responsible for lost, deleted, corrupted, overwritten, incomplete, or unrecoverable Location Data, Project Data, reports, exports, or analysis work.
9. Account, Subscription, and Technical Data
Although Map and Track does not store your Location Data or Project Data on its servers, we may collect and store limited information necessary to operate the Platform, manage accounts, provide support, process subscriptions, maintain security, and improve the service.
This may include:
- name;
- email address;
- organisation or agency details;
- account settings;
- subscription status;
- billing records;
- payment provider references;
- support requests;
- login information;
- IP address;
- browser type;
- device type;
- operating system;
- access times;
- usage logs;
- error logs; and
- general platform analytics.
Payment information may be processed by third-party payment providers. We do not store full credit card details unless expressly stated by the relevant payment provider.
You acknowledge that technical logs and account information may be required for security, billing, support, fraud prevention, service improvement, and compliance purposes.
10. User Content and Data Ownership
You retain ownership of the data, files, and content you use with Map and Track.
Nothing in these Terms transfers ownership of your Location Data, Project Data, reports, annotations, or uploaded files to us.
To the extent any temporary processing is required to provide a feature of the Platform, you grant us a limited, non-exclusive, revocable licence to process that data solely for the purpose of providing that feature to you.
We do not claim ownership over your investigative data, forensic material, case material, or analysis outputs.
11. Privacy and Security
We take reasonable steps to protect the security of the Platform and account-related information.
However, you acknowledge that no internet-connected system, browser-based application, software platform, or data transmission method can be guaranteed to be completely secure, uninterrupted, or immune from unauthorised access, misuse, malfunction, or error.
You are responsible for ensuring that your use of Map and Track complies with any privacy, data protection, confidentiality, evidentiary, or information security obligations that apply to you or your organisation.
You must not use Map and Track to process data where doing so would breach privacy legislation, court orders, warrants, confidentiality obligations, organisational policies, or any other legal requirement.
12. Lawful Authority and Acceptable Use
You must only use Map and Track for lawful purposes.
You agree that you will not:
- use the Platform without lawful authority;
- process Location Data that you are not authorised to access, analyse, or use;
- use the Platform in breach of any warrant, court order, policy, law, or regulation;
- use the Platform for unlawful surveillance, stalking, harassment, intimidation, discrimination, or harm;
- upload or process data in a way that infringes the rights of another person or organisation;
- attempt to gain unauthorised access to the Platform or its systems;
- interfere with the security or operation of the Platform;
- reverse engineer, decompile, disassemble, copy, or attempt to derive the source code of the Platform;
- bypass subscription, licence, authentication, or access controls;
- introduce viruses, malware, scripts, exploits, or harmful code;
- scrape, overload, or disrupt the Platform;
- resell, sublicense, or commercially exploit the Platform without written permission; or
- use the Platform in a way that could damage Map and Track, LESSER Innovations, other users, or third parties.
We may suspend or terminate access if we reasonably believe the Platform is being misused.
13. Accounts and Security
You may be required to create an account to access some or all features of Map and Track.
You agree to:
- provide accurate and current account information;
- keep your login credentials secure;
- not share your account with unauthorised users;
- promptly update your account information if it changes;
- notify us if you become aware of unauthorised access or a security breach; and
- accept responsibility for all activity that occurs under your account.
We are not responsible for loss, damage, unauthorised access, or misuse arising from your failure to secure your account credentials.
14. Subscriptions, Payments, and Access
Some features of Map and Track may require a paid subscription, licence, or active account.
Subscription terms, pricing, inclusions, billing frequency, renewal dates, cancellation rights, and payment conditions may be displayed separately at the time of purchase or through your account portal.
You are responsible for ensuring your payment details are current and that your subscription remains active.
We may suspend or restrict access to paid features if payment fails, a subscription expires, a trial ends, or account access is terminated.
Unless otherwise required by law or expressly stated, fees paid for Map and Track are non-refundable.
15. Reports and Outputs
Map and Track may generate maps, visualisations, timelines, replays, annotations, density views, intelligence zone summaries, movement analysis reports, narrative reports, or other outputs.
You acknowledge that these outputs are generated from the data provided to the Platform and may be affected by errors, omissions, inaccuracies, incorrect settings, incomplete source data, or user interpretation.
You are solely responsible for reviewing, validating, editing, contextualising, and verifying any output before using it in an investigation, report, briefing, statement, court proceeding, disciplinary process, or other formal setting.
Map and Track does not guarantee that any report or output is accurate, complete, admissible, reliable, or suitable for any particular purpose.
16. Third-Party Services and Map Layers
Map and Track may use or display third-party services, including map tiles, satellite imagery, geocoding services, payment processors, analytics tools, hosting providers, email services, or support systems.
Third-party services may be subject to their own terms, policies, limitations, outages, errors, rate limits, licensing restrictions, or data practices.
We are not responsible for the accuracy, availability, legality, reliability, or content of third-party services, maps, satellite imagery, labels, roads, addresses, business listings, points of interest, or external links.
You must independently verify any third-party information before relying on it.
17. Availability and Changes to the Platform
We aim to provide a reliable service, but we do not guarantee that Map and Track will always be available, uninterrupted, secure, or error-free.
Access may be interrupted, restricted, suspended, or unavailable due to:
- maintenance;
- updates;
- technical faults;
- hosting issues;
- third-party service outages;
- internet connectivity issues;
- cyber incidents;
- browser compatibility issues;
- changes to supported formats;
- account issues; or
- circumstances outside our control.
We may update, modify, remove, replace, or discontinue any feature of the Platform at any time.
18. No Warranty
To the maximum extent permitted by law, Map and Track is provided on an “as is” and “as available” basis.
We make no warranties, representations, or guarantees that:
- the Platform will meet your requirements;
- the Platform will be uninterrupted, timely, secure, or error-free;
- any defects will be corrected;
- any output will be accurate, complete, reliable, or suitable;
- any Location Data will be correctly interpreted;
- any report will be admissible or fit for legal proceedings;
- any data will be recoverable;
- the Platform will be compatible with every browser, device, file type, forensic tool, or data export; or
- the Platform will be free from viruses, vulnerabilities, or harmful components.
To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability, and non-infringement.
19. Limitation of Liability
To the maximum extent permitted by law, Map and Track, LESSER Innovations, its directors, employees, contractors, agents, and related parties are not liable for any loss, damage, claim, cost, expense, or consequence arising from or connected with your use of, or inability to use, the Platform.
This includes, but is not limited to, liability for:
- inaccurate Location Data;
- incorrect analysis;
- misinterpretation of data;
- reliance on Platform outputs;
- lost data;
- lost projects;
- corrupted files;
- deleted files;
- incomplete reports;
- failed exports;
- business interruption;
- loss of profit;
- loss of revenue;
- loss of opportunity;
- loss of goodwill;
- operational decisions;
- investigative decisions;
- legal decisions;
- disciplinary decisions;
- evidentiary issues;
- court outcomes;
- unauthorised access;
- security incidents;
- software errors;
- third-party service failures; or
- indirect, incidental, special, consequential, exemplary, or punitive damages.
You use Map and Track entirely at your own risk.
Where liability cannot be excluded by law, our liability is limited to the maximum extent permitted by law.
20. Indemnity
You agree to indemnify and hold harmless Map and Track, LESSER Innovations, its directors, employees, contractors, agents, and related parties from and against any claims, losses, liabilities, damages, costs, or expenses arising from:
- your use of the Platform;
- your breach of these Terms;
- your misuse of Location Data;
- your unauthorised use of data;
- your reliance on Platform outputs;
- your violation of any law, policy, warrant, order, or regulation;
- your infringement of third-party rights;
- your failure to independently verify data or outputs; or
- any report, conclusion, decision, or action taken using information generated by the Platform.
21. Intellectual Property
All intellectual property rights in Map and Track, including its software, source code, design, interface, branding, logos, workflows, reports, features, documentation, text, graphics, and underlying technology, are owned by or licensed to LESSER Innovations.
You are granted a limited, revocable, non-exclusive, non-transferable licence to use the Platform in accordance with these Terms and any applicable subscription or licence.
You must not copy, reproduce, modify, adapt, distribute, sell, lease, sublicense, reverse engineer, or commercially exploit any part of the Platform unless expressly authorised in writing.
22. Suspension and Termination
We may suspend, restrict, or terminate your access to Map and Track if:
- you breach these Terms;
- your subscription expires or payment fails;
- we suspect unauthorised or unlawful use;
- your account presents a security risk;
- we are required to do so by law;
- continued access may cause harm to us, other users, or third parties; or
- we discontinue the Platform or relevant service.
Upon termination, your right to access and use the Platform will cease immediately.
Because Map and Track does not store your Location Data or Project Data on its servers, you are responsible for ensuring that any required files, reports, projects, or exports are saved and preserved by you.
23. Changes to These Terms
We may update or replace these Terms from time to time.
When we make changes, we may update the “Last Updated” date at the top of this document or provide notice through the Platform.
Your continued use of Map and Track after changes are made constitutes acceptance of the updated Terms.
If you do not agree to the updated Terms, you must stop using the Platform.
24. Governing Law
These Terms are governed by the laws of Australia.
Subject to any applicable consumer protection laws or mandatory legal requirements, any dispute arising out of or relating to these Terms or the Platform will be dealt with by the courts of Australia.

26. User Acknowledgement
By using Map and Track, you acknowledge and agree that:
- Map and Track is an investigative aid only;
- Location Data can be inaccurate, incomplete, delayed, or misleading;
- all findings and outputs must be independently verified;
- Map and Track does not store your Location Data or Project Data on its servers;
- Location Data and Project Data are processed and analysed locally in your web browser;
- you are responsible for saving and preserving your own files, projects, and reports;
- Map and Track is not responsible for lost data, lost projects, inaccurate findings, or incorrect interpretation;
- you are solely responsible for lawful use of the Platform; and
- you accept these Terms and Conditions.
